Mail‑order vs. retail: mifepristone dispensing remains skewed after FDA rule change

Clinical takeaway: The FDA’s REMS update expanded who may dispense mifepristone, but it didn't meaningfully change where patients obtain it. Clinicians should not assume in‑store pickup is a realistic option for most patients and should plan counseling and timing around mail‑order access.

In January 2023, FDA permanently removed the requirement that mifepristone be dispensed in person at a clinic or hospital, allowing certified retail pharmacies to dispense the drug. The policy change was widely viewed as a step toward normalizing access through community pharmacies.

A new JAMA study shows how limited that shift has been in practice. Since the rule change, US pharmacies have filled about 2,700 mifepristone prescriptions per month. In the 27 states and Washington, DC, where abortion and telehealth are legal, fewer than 2% of those filled at pharmacies were dispensed in brick‑and‑mortar locations; the overwhelming majority were handled by mail‑order pharmacies. Among in‑store fills, independent pharmacies accounted for 92%, while large chains represented just 8%.

Dispensing patterns differed where telehealth is restricted: in 11 states where abortion remains legal but telehealth is limited, 61% of pharmacy fills occurred in retail settings.

“It’s striking how few retail pharmacies, particularly chains, are dispensing mifepristone where abortion is legal and telehealth is permitted,” said lead author Dima M. Qato, PharmD, MPH. The findings reinforce that regulatory change alone does not ensure on‑the‑ground access—and that mail‑order channels remain central to care delivery.
